Definitions

The “Bianchini Rosa” farm (hereinafter also referred to as “Azienda Agricola Bianchini”), with its registered office at Via Regina Margherita 32/1, Sant’Eufemia d’Aspromonte (RC), and its operational headquarters at Strada Martana km 1.4, Tuscania (VT), has created the website “aziendagricolabianchini.com” for the purpose of conducting e-commerce activities exclusively with end users (hereinafter also referred to as “Customer”). Customers agree not to make commercial use of the products purchased. All contracts entered into through the websites fall under the category of distance sales contracts between Azienda Agricola Bianchini (VAT No. 02552670800 and REA VT No. 156106) and the End User, for the purpose of selling and purchasing the goods (extra virgin olive oil and gift items) presented on the website.

The sale is governed by these Conditions, which are to be considered an integral and substantial part of the contract of purchase and sale. Before placing their orders, therefore, Customers are urged to read the Conditions of Sale carefully.

We reserve the right to update these terms and conditions at any time, including as a result of any changes in the law; these changes will be effective upon their publication.

Sending the order from the website is considered as acceptance by the Customer of the terms of sale in effect at that time and is applied as a sign of consent to purchase, thus finalizing the contract of sale.

Management of purchase orders

Supplier orders are handled as follows:

• The Customer submits the order by filling out the appropriate form found on the site.
• We transmit our acceptance of the order to the Customer by e-mail, indicating the main information and quantity of product ordered, its price, payment method, shipping method and respective charges, shipping address and billing information.
• Goods are shipped and delivered to the Customer's address.

The order will be accepted and filled only after the payment is credited. In the event that the quantity of products ordered exceeds the quantity we have on hand, the Customer will receive timely information via e-mail so that he/she can decide whether to replace the missing product or change or cancel his/her order free of charge; we will refund the Customer for any amounts he/she may have paid that were not compensated by the goods.

The Customer relieves Azienda Agricola Bianchini of any liability in the event that he/she incorrectly fills out the order form, even by simply indicating an incorrect delivery address and/or issuing incorrect tax documents, due to the fact that the Customer is the only person responsible for the correct entry of data in the order form. Minors under the age of 18 are not allowed to submit orders via the online order form.

Sales prices and billing

The product prices listed on the website are in euros and include VAT and all other taxes, as well as containers and packaging. Shipping within Italy is free for orders over €109; for orders under €109, a flat rate of €10 + VAT applies within Italy. For shipping to countries other than Italy (Germany and France), a flat rate of €25 + VAT applies.

Any promotions regarding sale prices and/or shipping costs are valid only for the period during which they are posted on our site.

Payment of the price can only be made in euros, and the amounts will be shown on the invoice in euros only. The invoice will be sent to the e-mail address indicated in the order.

Shipment management

Purchased items will be shipped within seven days of receiving the order, except for pre-orders placed between August and October, which allow customers to purchase products before they are manufactured and become available. In this case, customers will be promptly notified via email regarding the production status and will receive estimated shipping dates, followed by the exact shipping date.

The products ordered will be delivered to the shipping address provided by the Customer when placing the order.

Depending on the place of destination, deliveries can take anywhere from 2 to 10 days, inconveniences permitting. For large quantity shipments (greater than 30 kg), or for shipment to countries where no directions have been provided, please contact us directly at info@aziendagricolabianchini.com to receive a customized cost estimate.

You will receive a tracking number for your shipment in your order acceptance e-mail and/or in an e-mail sent directly from the courier company itself, so you can track your shipment until delivery by consulting the courier company's website. Also, by indicating a phone number in the shipping address form, you will be contacted directly by our couriers in case of non-delivery.

If the package is damaged upon delivery, we advise Customers to accept it, taking care to write "accepted with reservation" on the courier's transport document.

If, after inspecting the contents, you find that the products are indeed damaged, please notify us immediately by sending an email to info@aziendagricolabianchini.com, including your order number and attaching a video showing that the contents were damaged upon opening the package.

Return policy and refund criteria

If the Customer is not satisfied with the purchased products, he/she has the right to exercise the right of withdrawal by sending a written notice by PEC to the certified address bianchinirosa@pec.it", within 15 days of receipt of the purchased goods.

The Customer is requested to advance this communication to the e-mail address ordini@aziendagricolabianchini.com indicating the details of the purchase order and the order number as the subject of the e-mail.

Purchased products must be returned to our offices within 15 days of their receipt and, after checking the goods, we will refund the amount paid by bank transfer as soon as possible but, in any case, within 30 days of receiving the withdrawal notice.

Returned products must be sent to us intact, in their original packaging complete in all its parts, as originally received by the Customer. The return of products purchased by the Customer will be the responsibility of the Customer, in accordance with Art. 67, Par. 3 and 4 of Legislative Decree No. 206 dated 06/09/2005.

Our sales policy aims to meet our customers' expectations. So please inform us of any problem you may have; we will do our best to solve it as quickly and as best as possible.

Payment method

Payment can be made by Credit Card, PayPal, Apple Pay and Google Pay . - Credit Card purchases are handled entirely by the Stripe system, which Bianchini Farm cannot access in any way.

Jurisdiction

These Conditions of Sale and the contracts of purchase and sale entered into through the website aziendagricolabianchini.com are governed by Italian Law, given the EEC directives "Legislative Decree 6/09/2005 No. 206 Consumer Code - Legislative Decree 9/04/2003 No. 70 - as amended and supplemented).

The Client releases Azienda Agricola "Bianchini Rosa" from any responsibility in relation to any malfunction or interruption of services and drop in performance, whether or not this is due to force or chance, when not directly attributable to Azienda agricola Bianchini itself due to intentional wrongdoing or negligence. Any disputes relating to the interpretation of these terms and conditions of sale and business relations arising out of Azienda agricola Bianchini and the Client shall fall under the sole jurisdiction of the Courts of Viterbo
